Vietnam’s First Crypto Administrative Penalty Decree Takes Effect, Establishing a “Grace Period” Prior to Licensed Exchanges Going Live

On September 1st, Vietnam’s Decree No. 284/2026/NĐ-CP on administrative penalties for crypto assets officially took effect. As the country’s first regulatory document specifically addressing crypto-related violations, here are 3 key points investors need to keep in mind: Vietnam crypto exchange

Maximum Penalty Limits: Fines are capped at up to 100 million VND for individuals and up to 200 million VND for organizations.

Penalties for Unlicensed Trading: Domestic individual investors trading without going through entities licensed by the Ministry of Finance face potential fines of 30 to 50 million VND.

Enforcement Activation Criteria: According to Mr. Tô Trần Hòa, Deputy Head of the Standing Committee of the Crypto Asset Trading Market Management Board under the State Securities Commission, penalty provisions targeting investors will only be activated once Vietnam has its first exchange officially licensed by the Ministry of Finance. Currently, 5 applications have received approval-in-principle and are finalizing their remaining licensing conditions.
This means that while the decree enters into force starting tomorrow, no penalties will be imposed on individual investors for the time being, given that no compliant exchanges are currently operational.
