What Does Vietnam’s 6-Month Grace Period for Crypto Assets Mean?

Under Resolution No. 05/2025/NQ-CP and the accompanying Decree No. 284 on enforcement, the government announced regulatory oversight and penalties for illegal crypto platforms. However, recognizing that local licensed exchanges are not yet officially live, regulators established a compliance transition framework to avoid punishing mass non-compliance and to protect retail investor interests:

  • Countdown Trigger: The grace period does not start on the decree’s enactment date. Instead, the 6-month countdown begins on the exact day the government issues and announces the first local licensed exchange license.

  • Required Action: Before the countdown ends, local retail investors must transfer their regulated crypto assets stored or traded on unlicensed offshore platforms (such as Binance or OKX) to licensed local platforms recognized by the Ministry of Finance and the State Securities Commission (SSC).

Policy Logic During the Grace Period

  • Safe Harbor (No Current Penalties): Since no exchange in Vietnam currently holds an official operating license, retail users continuing to trade on offshore platforms are not in violation and face no administrative fines at this stage.

  • Deferred Risk of Non-Compliance: Once the 6-month grace period expires, Vietnamese residents who continue trading crypto assets on unauthorized overseas or illegal platforms will face administrative fines ranging from 15 million to 50 million VND (with significantly higher penalties for institutional violations).

  • Targeting “Trading” Rather Than Pure “Holding”: The policy specifically targets and regulates buying, selling, trading, and settlement on unlicensed platforms. Simply storing cryptocurrency in a hardware wallet (cold wallet) is generally not subject to these trading bans or direct penalties.

Current Investor Strategy

  • Stay Informed: Keep a close eye on official announcements from the State Securities Commission (SSC) regarding the issuance of the first exchange license.

  • No Need for Panic Selling: During the window before the first license is officially granted, retail investors have ample time to plan asset transfers or compliance filings.
